Introduction
This document does not replace the General Terms and Conditions or the Privacy Policy of Yes Superfood Trading Kft., but rather serves as a complementary resource, providing more detailed guidance regarding the company's international sales, communications, and gastronomy-related activities.Its contents apply to all commercial, data management, marketing, communication, and cross-border operations.
Product Classification and Content Usage
The products distributed by Yes Superfood Trading Kft. (e.g., blue spirulina, butterfly pea powder, activated charcoal, dragon fruit powder, etc.) fall under the scope of the Hungarian Regulation 37/2004 (IV. 26.) ESzCsM on food supplements, as well as EU Directive 2002/46/EC.
Content published on the company’s websites, social media channels, and other platforms—such as recipes, usage examples, user-generated photos, and illustrations—is intended solely for gastronomic inspiration.
These materials do not constitute medical, health-related, or nutritional advice, and do not replace the official dosage and usage instructions provided on the product packaging.
Visual representations serve illustrative purposes only; color, texture, and intensity of the product may vary depending on the method of use, quantity, and context.
International Sales and Limitation of Liability
Yes Superfood Trading Kft. distributes its products both within Hungary and internationally.
By placing an order, the customer acknowledges that the legal classification of the product may differ in their own country and assumes full responsibility for complying with local laws concerning the importation, sale, and use of the product.
Yes Superfood Trading Kft. disclaims all liability for: improper or misinterpreted use of the product, failure to comply with national regulations, consequences arising from resale by third-party distributors.
Data Processing, Data Transfers, and Profiling
Data processing for the purposes of order fulfillment, invoicing, newsletter distribution, and marketing communication is carried out in accordance with the General Data Protection Regulation (GDPR).
The scope of data processed, legal basis, and data retention periods are detailed in the company’s Privacy Policy.
No automated decision-making or profiling takes place.
For international orders, data necessary for delivery (e.g., name, address, email, telephone number) may be transferred to logistics partners within the EU or in third countries. All such transfers are conducted in full compliance with EU data protection regulations.
User-Generated Content and Social Media Sharing
If a customer tags the official Yes Superfood account on any social media platform (e.g., Instagram, Facebook, TikTok), or shares content featuring Yes Superfood products while referencing the company, such content shall be considered a public contribution authorizing the company to reuse it.
In all cases, the original source will be clearly acknowledged when republishing.
Newsletter, Affiliate, and Remarketing Activities
Newsletter Distribution
Yes Superfood only sends newsletters to users who have provided their prior, voluntary, and explicit consent to receive electronic direct marketing communications.
All newsletters include an easy-to-use, immediate unsubscribe option. Consent can be withdrawn at any time without justification.
Affiliate Operations
Affiliate partners may only promote Yes Superfood products based on a signed written agreement.
Partners may only use materials (visual, textual, or marketing-related) that have been pre-approved by Yes Superfood.
They must refrain from making any claims regarding health benefits, disease prevention, or treatment, and are not permitted to promote alternative or unofficial product uses.
All affiliate agreements outline the principles of brand protection and applicable penalties in the event of violations.
Unauthorized Third-Party Content
Yes Superfood Trading Kft. does not collaborate with individuals or organizations who are not under contract.
Should any third party advertise or promote Yes Superfood products using health-related or therapeutic claims without the company’s knowledge or permission, such content does not reflect the company’s official position or communication.
The company explicitly disclaims any liability for publicly shared content not originating from its approved marketing channels.
Remarketing and Data Protection Compliance
During remarketing campaigns, Yes Superfood targets only aggregated, statistical user segments (e.g., “visitors from the past 30 days”) and does not engage in individual behavioral analysis or personalized profiling.
The company does not use automated decision-making processes and does not send personalized offers based on individual purchasing behavior.
Remarketing activities are carried out under the legitimate interest legal basis as defined in Article 6(1)(f) of the GDPR, with appropriate balancing of interests.
B2B Resale
Yes Superfood only collaborates with B2B partners who: accept delivery of goods under contract, agree not to modify the packaging or official product description, undertake not to make legally disputable claims in Hungary or abroad.
B2B agreements do not authorize subcontracting or conduct that could diminish the brand’s reputation or value.
Shipping Territories and Country-Specific Information
Yes Superfood Trading Kft. ships its products to selected countries.
The current list of eligible countries is available in the "Shipping Information" section of the company’s websites and is displayed during the checkout process.
The company reserves the right to: suspend or refuse shipping to certain countries, cancel orders if legal, customs, or food safety regulations in the destination country so require, ship only to destinations where logistical and legal conditions allow safe and compliant delivery.
It is the customer’s responsibility to verify whether import and use of the products are lawful in their country.
Legal Scope and Applicable Law
This document is intended as a supplement and does not replace Yes Superfood Trading Kft.’s General Terms and Conditions or Privacy Policy.
It complements the company's practices related to gastronomic communications, international sales, and data management compliance.
In the event of any legal dispute, Hungarian law shall apply, with the exclusive jurisdiction of the Budapest Metropolitan Court.
